1. Eligibility

To use RandAvatar, you must be at least 13 years old. By using our Services, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

2. Account Registration

In order to use certain features of RandAvatar, you may need to create an account. You agree to provide accurate and complete information during the registration process and to keep your account information up to date. You are responsible for maintaining the confidentiality of your account login information.

3. Permitted Use

You may use RandAvatar for lawful purposes only. You are granted a non-exclusive, non-transferable, revocable license to access and use our Services in accordance with these Terms. While we encourage creative expression, any use of our Services for the following activities is strictly prohibited:

• Uploading, sharing, or distributing illegal content or materials that promote harm, exploitation, or discrimination, including but not limited to hate speech, child exploitation, and illegal content.
• Engaging in activities that infringe upon the intellectual property rights of others.
• Engaging in harassment, spamming, or any other form of abusive behavior.
• Using our Services for any fraudulent, deceptive, or unlawful activities.

Content such as blood, gore, body horror, and other similar themes are permitted, provided they comply with all applicable laws and are not used for malicious purposes. However, any content that is deemed harmful or illegal in nature, including the creation or distribution of illegal images, is strictly prohibited.

4. User-Generated Content

RandAvatar allows users to upload and manage images, which are stored and made accessible through unique URLs. You are solely responsible for any content that you upload to our Services. By uploading content, you grant RandAvatar a worldwide, non-exclusive, royalty-free license to use, display, and distribute your content as necessary to operate and improve our Services.

You represent and warrant that the content you upload:

• Does not violate any applicable laws, regulations, or third-party rights, including but not limited to intellectual property rights, privacy rights, and moral rights.
• Does not contain any illegal, harmful, offensive, or otherwise inappropriate content.
• Does not promote violence, discrimination, or any other forms of harm to individuals or groups.

RandAvatar reserves the right to remove or disable access to content that violates these Terms or that we deem inappropriate at our sole discretion.

5. Prohibited Conduct

You agree not to:

• Attempt to gain unauthorized access to our Services or any part of them.
• Use the Services for any illegal or malicious purposes, including fraud, impersonation, or identity theft.
• Distribute or upload viruses, malware, or any harmful code.
• Engage in any behavior that could interfere with or disrupt the functionality of RandAvatar.

6. Account Termination

RandAvatar reserves the right to suspend or terminate your account, without prior notice, if we determine, at our sole discretion, that you have violated these Terms. Upon termination, you will lose access to all your content and any other account-related features.

7. Limitation of Liability

RandAvatar provides its Services "as is" and makes no representations or warranties, either express or implied, regarding the accuracy, reliability, or availability of the Services. In no event will RandAvatar be liable for any indirect, incidental, special, or consequential damages arising from your use of our Services, including loss of data, profits, or business opportunities.

8. Indemnification

You agree to indemnify and hold harmless RandAvatar, its affiliates, and its employees, from any claims, damages, liabilities, and expenses (including legal fees) arising from your violation of these Terms or your use of our Services.

9. Modifications to the Terms

RandAvatar may update or change these Terms at any time. If we make significant changes, we will provide notice on our website. Your continued use of our Services after such changes constitutes your acceptance of the updated Terms.

10. Governing Law

These Terms will be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law principles. Any disputes will be resolved in the courts located in the United States.
